POPIA Privacy Policy
Obert Rukato Clinical Psychology, trading as OTR Psychology ("the practice", "we"), is the responsible party for personal information processed through this website and in the course of clinical care. This policy explains how we process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA), the National Health Act, and the ethical rules of the Health Professions Council of South Africa (HPCSA).
Information we collect
- Identifying details such as name, contact number, email address and, where relevant, ID and medical aid details.
- Health information, including clinical history, assessment findings and session notes (special personal information under POPIA).
- Booking information submitted through the third-party Google Calendar booking link.
- Basic technical information generated when you visit this website.
Purpose of processing
Personal information is processed to schedule and provide psychological services, maintain legally required clinical records, submit medical aid claims where applicable, communicate with you about your care, and comply with legal and professional obligations.
Consent and lawful basis
Health information is processed with your consent, or as otherwise permitted by section 32 of POPIA for the provision of health care. Consent may be withdrawn at any time, subject to record-keeping duties that require clinical records to be retained.
Confidentiality and sharing
Clinical information is confidential. It is disclosed only with your written consent, or where disclosure is required or permitted by law — for example where there is a serious risk of harm to you or another person, in cases of child or elder abuse, or under a court order or statutory duty. Limited information may be shared with your medical aid scheme for claims purposes, and with secure service providers (such as scheduling and telehealth platforms) bound by confidentiality obligations.
Security and retention
Reasonable technical and organisational safeguards are used to protect personal information against loss, unauthorised access or disclosure. Clinical records are retained for the minimum periods required by the HPCSA and the National Health Act, and are then securely destroyed.
Your rights
- Request access to the personal information we hold about you.
- Request correction or deletion of information, subject to legal retention duties.
- Object to processing in certain circumstances.
- Lodge a complaint with the Information Regulator (South Africa).
